Authoritative version

This is a translation for convenience. The German version of this privacy policy is the authoritative one.

1. Data protection at a glance

General information

The following information provides an overview of what happens to your personal data when you visit this website. Personal data is any data by which you can be personally identified. Detailed information can be found in the sections below.

Who is responsible for collecting data?

Data processing on this website is carried out by the website operator. You will find their contact details in the section “Information on the controller”.

How do we collect your data?

On the one hand, because you provide it to us – for example via the contact form. On the other hand, our server automatically records technical data such as browser, operating system and time of access when the website is called up.

What do we use your data for?

The automatically collected data is used to provide the website free of errors and to protect its operation. We use the details you enter in the contact form to handle your enquiry.

This website does not analyse your behaviour

Your browsing behaviour is not analysed. We use no analytics or tracking services, no advertising networks and no social media plugins. When the page is loaded, no content is retrieved from third-party servers – fonts, images and scripts are held exclusively on our own server.

What rights do you have?

You have the right at any time to obtain information about the origin, recipients and purpose of your stored personal data free of charge. You also have the right to request the correction or deletion of this data, may withdraw any consent given at any time and, under certain circumstances, may request that processing be restricted. You also have the right to lodge a complaint with the competent supervisory authority.

2. Hosting

We host the content of this website with the following provider:

Hetzner

The provider is Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany (hereinafter “Hetzner”).

The server on which this website is operated is located in the Nuremberg data centre park (site NBG1), Sigmundstraße 135, 90431 Nuremberg, Germany. No processing takes place outside Germany.

Hetzner privacy policy

Hetzner is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. Where consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG, in so far as the consent covers the storage of cookies or access to information on the user’s device. Consent may be withdrawn at any time.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the service named above. This is a contract required under data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General information and mandatory disclosures

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with statutory data protection regulations and this privacy policy.

We would like to point out that data transmission over the internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.

Information on the controller

The controller for data processing on this website is:

  • INFINTEQ GmbH
  • Wissollstraße 18
  • 45478 Mülheim an der Ruhr, Germany
  • Phone: +49 208 306638-00
  • E-mail: info@infinteq.com

The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data.

Data protection officer

We have appointed a data protection officer:

  • Mirco Dzilum
  • INFINTEQ GmbH
  • Wissollstraße 18
  • 45478 Mülheim an der Ruhr, Germany
  • Phone: +49 208 306638-00
  • E-mail: info@infinteq.com

Storage period

Unless a more specific storage period is stated within this privacy policy, your personal data will remain with us until the purpose for processing no longer applies. If you assert a justified request for deletion or withdraw your consent, your data will be deleted unless we have other legally permissible grounds for storing it – for example retention periods under tax or commercial law. In the latter case, deletion takes place once those grounds cease to apply.

General information on the legal bases

Where you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR where special categories of data pursuant to Art. 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, processing is additionally based on Art. 49(1)(a) GDPR. Where you have consented to the storage of cookies or to access to information on your device, processing is additionally based on Section 25(1) TDDDG. Consent may be withdrawn at any time. Where your data is required for the performance of a contract or for pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data where it is required to fulfil a legal obligation, on the basis of Art. 6(1)(c) GDPR. Processing may also be carried out on the basis of our legitimate interest pursuant to Art. 6(1)(f) GDPR.

Recipients of personal data

In the course of our business activities we work with various external parties. This sometimes requires personal data to be transferred to those parties. We only pass personal data to external parties where this is necessary for the performance of a contract, where we are legally obliged to do so, where we have a legitimate interest in the transfer pursuant to Art. 6(1)(f) GDPR, or where another legal basis permits the transfer. Where processors are used, we pass on our customers’ personal data only on the basis of a valid data processing agreement.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your express consent. You may withdraw consent already given at any time. The lawfulness of the data processing carried out prior to the withdrawal remains unaffected.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THOSE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION PURSUANT TO ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSES OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSES OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING IN SO FAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSES OF DIRECT MARKETING (OBJECTION PURSUANT TO ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of infringements of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work or the place of the alleged infringement. This right is without prejudice to any other administrative or judicial remedy.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only take place in so far as it is technically feasible.

Information, correction and deletion

Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to correction or deletion of this data. You can contact us at any time regarding this and any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us at any time to do so. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we generally need time to verify this. For the duration of the review, you have the right to request the restriction of processing.
  • If the processing of your personal data was or is unlawful, you may request the restriction of processing instead of deletion.
  • If we no longer need your personal data but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of processing instead of deletion.
  • If you have lodged an objection pursuant to Art. 21(1) GDPR, a balance must be struck between your interests and ours. As long as it has not been determined whose interests prevail, you have the right to request the restriction of processing.

If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise or defence of legal claims, or to protect the rights of another natural or legal person, or for reasons of important public interest of the European Union or a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the browser’s address bar changes from “http://” to “https://” and by the padlock symbol in your browser bar. When encryption is active, the data you transmit to us cannot be read by third parties.

Objection to advertising e-mails

We hereby object to the use of contact data published within the scope of the legal notice obligation for sending advertising and information material that has not been expressly requested. The operators of these pages expressly reserve the right to take legal action in the event of the unsolicited sending of advertising information, for example by spam e-mails.

4. Data collection on this website

Cookies

In normal operation this website sets no cookies. Nor does it store anything else on your device – neither in the browser’s local storage nor by any other means.

A single cookie is created, and only if you log in to a password-protected area: a session cookie that remembers your login for the duration of your visit. It contains no personal details, is deleted when the browser is closed and is technically necessary – without it, logging in does not work. Storage takes place pursuant to Section 25(2) no. 2 TDDDG and does not require consent.

For the same reason there is no consent banner on this website: there is no consent-requiring cookie to consent to.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • anonymised IP address

This data is not merged with other data sources. It is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, server log files must be recorded.

The server log files are deleted automatically after 14 days.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact data you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

Technically, the transmission takes place as an e-mail to our mailbox. Our e-mail system is Microsoft 365; the provider is Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, Ireland. Microsoft processes the content of your enquiry as a processor on our behalf. The basis for this is Microsoft’s Data Protection Addendum, which forms part of the product terms.

Microsoft privacy statement

To prevent mass misuse of the form, our server limits the number of submissions per sender. For this purpose your IP address is not stored; instead, only an irreversible check value (HMAC) is recorded, from which the address cannot be derived. The value expires after one hour. In addition, the time between the page being loaded and the form being submitted is evaluated in order to detect automated submissions. The legal basis is Art. 6(1)(f) GDPR; our legitimate interest lies in protection against misuse.

This data is processed on the basis of Art. 6(1)(b) GDPR where your enquiry is connected with the performance of a contract or is necessary for pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) where this has been requested; consent may be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to storage, or the purpose for storing the data no longer applies. Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiry by e-mail, telephone or fax

If you contact us by e-mail, telephone or fax, your enquiry including all resulting personal data (name, enquiry) will be stored and processed by us for the purpose of handling your request. We do not pass on this data without your consent.

The data you send us via contact enquiries will remain with us until you ask us to delete it, withdraw your consent to storage, or the purpose for storing the data no longer applies. Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Fonts

Locally hosted fonts

For the uniform display of typefaces, this site uses the fonts Archivo, IBM Plex Sans and IBM Plex Mono as well as an icon font. All fonts are installed locally and are loaded exclusively from our own server. No connection is made to servers operated by Google, Adobe or other providers; no data is transferred to third parties.

6. Our own services

Handling of applicant data

We offer you the opportunity to apply to us. Below we inform you about the scope, purpose and use of the personal data collected from you in the course of the application process. We assure you that the collection, processing and use of your data is carried out in accordance with applicable data protection law and all other statutory provisions, and that your data is treated in strict confidence.

Scope and purpose of data collection

If you send us an application, we process your associated personal data (e.g. contact and communication data, application documents, notes taken during interviews, etc.) in so far as this is necessary in order to decide on the establishment of an employment relationship. The legal basis for this is Section 26 BDSG under German law (initiation of an employment relationship), Art. 6(1)(b) GDPR (general contract initiation) and – where you have given consent – Art. 6(1)(a) GDPR. Consent may be withdrawn at any time. Within our company, your personal data is passed on only to persons involved in processing your application.

If the application is successful, the data you submit will be stored in our data processing systems on the basis of Section 26 BDSG and Art. 6(1)(b) GDPR for the purpose of carrying out the employment relationship.

Applications via softgarden

We handle our job advertisements and the application process using the applicant management system of softgarden e-recruiting GmbH, Tauentzienstraße 14, 10789 Berlin, Germany. If you select a position on our careers page and follow the link to apply, you leave our website and are taken to a service operated by softgarden. The data you enter there is processed by softgarden on our behalf; we have concluded a data processing agreement for this purpose.

Simply viewing our careers page does not transfer any data to softgarden: the list of open positions is retrieved by our server and delivered to your browser. A connection from your browser to softgarden is only established when you click an application link.

softgarden privacy policy

Retention period

If we are unable to make you a job offer, if you decline a job offer or withdraw your application, we reserve the right to retain the data you have transmitted on the basis of our legitimate interests (Art. 6(1)(f) GDPR) for up to 6 months from the end of the application procedure (rejection or withdrawal of the application). The data is then deleted and physical application documents are destroyed. Retention serves in particular as evidence in the event of a legal dispute. If it is apparent that the data will be required after the 6-month period has expired (e.g. because of impending or pending legal proceedings), deletion will only take place once the purpose for further retention no longer applies.

Longer retention may also take place if you have given corresponding consent (Art. 6(1)(a) GDPR) or if statutory retention obligations preclude deletion.
